Nevada Guard Top Brass to Testify in Whistleblower Hearing

After more than three years of legal battles, US Marine Corps and Nevada National Guard Combat Veteran Andrew "Andy" Lindstrom is set to have his day in court on April 19, 2024.

(Carson City, Nevada) After more than three years of legal battles, US Marine Corps and

Nevada National Guard Combat Veteran Andrew "Andy" Lindstrom is set to have his day in

court on April 19, 2024.


Lindstrom's ordeal began in 2019 when he filed an Inspector General (IG) report, including evidence and eyewitness statements alleging sexual misconduct, including Military Sexual Trauma (MST), as well as financial embezzlement by senior military personnel and state contractors.


Following his whistleblowing, Lindstrom faced retaliation, leading to his dismissal from the

Nevada National Guard and termination from his civilian role at the Nevada Office of the

Military. The upcoming hearing represents a significant step in Lindstrom's prolonged fight for

justice and accountability within the military establishment.


Unwilling to allow predators in the ranks to escape accountability, Lindstrom, a former sergeant,

approached his fight for justice like it was another military mission. "At the end of the day, it's

paperwork. Incredibly repetitive confusing paperwork, but it's still paperwork," Lindstrom says

whenever asked how he has managed to get this far without a lawyer. "Google is my lawyer."


There is an instruction or law that dictates what paperwork needs to be filed and you can google

the law, the form and the process."


The hearing will thoroughly examine the retaliatory actions taken against Lindstrom following

his whistleblower report on misconduct within the Nevada National Guard. Central to his

argument is the role of Col. Kevin Remus in conducting a retaliatory investigation against him

and his consistent refusal to comply with the National Guard Bureau's directives to release

essential documents.


Lindstrom will also scrutinize the actions of State Attorney General Scott Husbands and Nevada National Guard Adjutant General Maj. Gen. Ondra Berry, assessing their participation in the retaliation process and their reactions to the serious issues he raised. This hearing is crucial for establishing a definitive record of accountability and ensuring the principles of justice and integrity are maintained within the military framework.


Remus, a key witness aware of the upcoming hearing since last November, has avoided

subpoena service, including dodging three in-person attempts by process servers and one

electronic service attempt.


He responded to the electronic service attempt, asserting that he was a represented party and could not accept service, but refused multiple requests to provide the name of his attorney. **Attached to this release is a list of witnesses expected to testify at the hearing.

Ondra Berry: Adjutant General of Nevada; ordered retaliatory firing based on the investigation

that was conducted during the periods of Lindstrom’s employment


Robert Boldry: Employed by the Division of Emergency Management and engaged in

harassment during the periods Lindstrom was employed for the Nevada Office of the Military

and also involved in the investigation alleged in the complaint


Clayton Chappelle: Director of State I&E where Lindstrom was employed from February 2021

- May 2022


Justin Harris: Also involved somehow in investigation that was started based on being included

in disclosure of covering up sexual harassment during State-sanctioned Nevada State Milita

Training.


Stephen Lawrence: Employed by the Division of Emergency Management and also engaged in

bullying and harassment and the investigation


Danielle Meadows: Paralegal who works in the State Judge Advocates Office under Mr. Remus

and Major General Berry's authority; contacted the hearing officer in this matter and introduced

herself as the Paralegal for the Nevada Office of the Military. Since the main argument of the

respondent is about the legal status of the Nevada National Guard, her testimony is necessary to

determine the legal status of the Nevada National Guard (Nevada State Militia).


Jacob Parker: Investigating Officer for the Army 15-6 that led to termination that is named in

the whistleblower complaint


James Phoenix: Provost Marshal who also was involved with investigation; primary point of

contact between the State Judge Advocate, HR Department for the Nevada Office of the

Military, and the Adjutant General


Curtis Kolvet: LTC who engaged in improper sexual relationship (fraternization) that

Lindstrom was suspected of disclosing during the period of employment. Based on mail evidence

it appears he worked with Remus on the investigation


Chad Reese: Supervisor who executed termination under direction of Cheryl Tyler, the HR

Director for the NV OOM


Kevin Remus: State Judge Advocate who gave legal representation and advice on the

initialization of the investigation


Christopher Tinsman: Former JAG Officer in the Nevada National Guard with over ten years

of experience and worked directly under COL Remus and is a legal expert and will provide

testimony on the legal Status of the Nevada State Militia, applicability of regulations and laws

for the Nevada State Militia.


Cheryl Tyler: Ordered the termination on behalf of Major General Berry as a result of the

investigation


Valarie Wilson: Works in HR for the Nevada Office of the Military and also participated in
